What Sets Us Apart
Why File Chapter 13?
There are a few advantages to filing Chapter 13 bankruptcy.. For one, Chapter 13 allows individuals to save their homes from foreclosure and make all their delinquent mortgage payments over time. Chapter 13 can also protect your vehicle while you catch up on payments and get the vehicle paid in full. A Chapter 13 also allows you to reschedule secured debts and extend them over the lifetime of the approved repayment plan, often at a lower interest rate than what you are currently paying, which may actually reduce the payments.
Chapter 13 also provides important protection against collection actions. As outlined in 11 U.S.C. Sec. 362, Chapter 13 bankruptcy stops most collection actions against the debtor and their property, which can help you retain some sort of “normal” as you work on paying off your debts (note that 11 U.S.C. Sec. 362 lists some actions Chapter 13 may not halt, such as child custody cases).
